This article proposes a guideline to develop an ontology of software. The first section gives a brief introduction to the importance of such ontology as a possible conceptual grounding for the philosophy of software, philosophy of computing and philosophy of information. The second section presents the background of the scope of this article in terms of both a symbolic and materialistic approach to software. The third section deploys the basic guidelines with the expositions of the two dimensions of software: the (...) serial dimension and the structural dimension. The first dimension consists of three series, while the second in the exposition of the structure of any program. The fourth and last section will deal with a better understanding of what we can call the digital universe. (shrink)

COVID-19 has substantially affected our lives during 2020. Since its beginning, several epidemiological models have been developed to investigate the specific dynamics of the disease. Early COVID-19 epidemiological models were purely statistical, based on a curve-fitting approach, and did not include causal knowledge about the disease. Yet, these models had predictive capacity; thus they were used to ground important political decisions, in virtue of the understanding of the dynamics of the pandemic that they offered. This raises a philosophical question about (...) how purely statistical models can yield understanding, and if so, what the relationship between prediction and understanding in these models is. Drawing on the model that was developed by the Institute of Health Metrics and Evaluation, we argue that early epidemiological models yielded a modality of understanding that we call descriptive understanding, which contrasts with the so-called explanatory understanding which is assumed to be the main form of scientific understanding. We spell out the exact details of how descriptive understanding works, and efficiently yields understanding of the phenomena. Finally, we vindicate the necessity of studying other modalities of understanding that go beyond the conventionally assumed explanatory understanding. (shrink)

Johannes Kepler dedicated much of his work to discover a law for the refraction of light. Unfortunately, he formulated an incorrect law. Nevertheless, it was useful for anticipating the behavior of light in some specific conditions. Some believe that Kepler did not have the elements to formulate the law that was later accepted by the scientific community, that is, the Snell–Descartes law. However, in this paper, we propose a model that agrees with Kepler’s heuristics and that is also successful in (...) anticipating the behavior of light when it passes through a surface that separates two media with different optical densities. This model adopts strategies that were recommended by Kepler in two types of analogies. The obstacles that led to the failure of the two types of analogies are presented in the article, and we argue that the model proposed here could overcome these specific obstacles. Finally, we show how the proposed model could be articulated with Kepler’s metaphysics of light. (shrink)

Puesto que la duda primordial de qué hay después de la muerte no puede ser satisfecha, la venta del alma se convierte en una transacción fútil o trágica, según fuera la respuesta, que ningún Fausto llega a dilucidar. Mefistófeles, el mensajero del diablo, no tiene más remedio que convertirse en un mago o en un bufón para distraer a su señor terrenal, para que no piense en temas trascendentales ni se dé cuenta de las limitaciones de su siervo. Durante cuatro siglos, los personajes de esta leyenda se han adaptado a los cambios filosóficos, sociales, políticos y económicos del mundo occidental y a su reflejo en el arte. En las últimas décadas el duelo dialéctico Fausto / Mefistófeles se ha adaptado al desarrollo de la teoría y de la ciencia en nuestra sociedad; así, encontramos feminizaciones del mito, Faustos transculturales, postmodernos y altamente tecnificados. La necesidad de utilizar un nuevo lenguaje para nombrar históricos cambios institucionales, la explosión de la prensa periódica en paralelo a nuevas ideas sobre la vigencia temporal de la norma, la pervivencia de formas orales de expresión jurídica sin perjuicio, falsa paradoja, del auge de la imprenta... presentan (...) varias dificultades al investigador, como las derivadas del empleo de las revistas y las obras de producción seriada, sin olvidar las incertidumbres que reodearon el tenor de los textos legales, y aun constitucionales. The objective of this article was to gain insight into the community health practices of the Awá-Camawari indigenous people of the Vegas Chagüi Chimbuza reservation, situated within the Ricaurte municipality of the Nariño Department. The methodology was qualitative, with a review of the literature supported by the hermeneutical historical approach. Interviews were conducted with 16 informants and two petition rights holders. The findings indicate that there has been minimal progress in the community-differential health model. There are shortcomings in public health (...) policies for indigenous peoples, which have weaknesses and intermittencies that hinder changes. The practices are based on traditional medicine. In conclusion, there are routes that can be taken to guarantee the right to community health, with alliances and strategies that can be used to build collective interest plans that overcome the status quo. This paper critiques a narrative concerning causality in later scholasticism due to, among others, Des Chene, Carraud, Schmaltz, Schmid, and Pasnau. On this account, internal developments in the scholastic tradition culminating in Suárez lead to the efficient cause being regarded as the paradigmatic kind of cause, anticipating a view explicitly held by the Cartesians. Focusing on Suárez and his scholastic reception, I defend the following claims: a) Suárez’s definition of cause does not privilege efficient causation; b) (...) class='Hi'>Suárez’s readers, from Timpler to Arriaga, did not interpret him as privileging efficient causation; c) it is only much later, in Clauberg, that we find a narrowing of the meaning of causation to efficient causal action; but d) this shift is better explained by Clauberg’s rejection of substance hylomorphism in favor of Descartes’s doctrine of substance, rather than by any troubles within the Aristotelian causal framework. It is a much neglected fact that the young Leibniz expressed particular interest for the philosophy of Johannes Clauberg, a follower of Descartes with Aristotelian outlook who taught at the University of Duisburg. Indeed he found here, against the background of Cartesianism, important impulses and preconceptions for important basic positions of his, which in many respects can be understood as extensions and unfoldings of Claubergian approaches. In this way nothing less than a story of creation and development of Leibnizian thought (...) is uncovered, e. g. from the gnoseological (symbolism of ideas; differentiation of nominal and real definitions, truths of reason and fact; the importance of real existence for the coherence of concepts) to the ontological area (the preparation of Leibnizian monadology through the question about the character of being in the innate ideas of Descartes; development of the concept of potency by means of that of facultas to that of virtus, of the petites perceptions of Leibniz and accordingly, for the first time in intellectual history, to his basic understanding of the unconscious): Further development of the anthropological question formulation through the idea of pre-established harmony. Leibniz’s first essay, his dissertation on the principle of individuality, is mainly dedicated to a critique of Duns Scotus’s explanation of individuation. Leibniz’s critique of Scotus and the historical antecedents of the German philosopher’s position have not been studied before. The paper examines Scotus’s and Leibniz’s views on individuation and sheds some light on the doctrinal genealogy that leads up to Leibniz’s position. I argue that Leibniz’s view and his critique of Scotus depend upon William of Ockham and Francis (...) class='Hi'>Suárez. Ockham, Suárez, and Leibniz posit that individuals are such by themselves or by their entire entity, rather than by an entity that is only a part of their being (as Scotus’s ‘haecceity’). Furthermore, all three take issue with Scotus’s view for the same reason, i.e. because they reject the formal distinction, a key assumption in Scotus’s account of individuation. (shrink)

This article sets out a novel analysis of Sir Robert Filmer's (1588-1653) well-known but often misread Patriarcha (1620s-30s). Claiming that a preoccupation with John Locke's criticism of Filmer has had distorting effects on modern historiography and has prevented an appropriate contextual approach to the work. The article proceeds along four lines. Firstly, drawing on the discovery of a manuscript note it re-maps the configuration of its arguments, aims and intellectual milieu. Secondly, it presents the treatise as the powerful articulation of (...) the patriarchalist paradigm deployed to attack the emerging language of county patriotism and the theory of papal deposing power formulated by Jesuit thinkers like Robert Bellarmine and Francisco Suarez. Thirdly, it places Patriarcha in the context of the late 1620s' parliamentary debates from which emerged the Petition of Right (1628) illuminating the reasons why Filmer made use of the notion of the king as pater patriae with the aim of opposing (quasi)-republican defenders of the so-called `common people'. Finally, the article reshapes the role of patriarchalism in the history of early modern European political thought, especially with regard to the centrality of the idea of `arbitrary' power. L? Esquisse d?une théorie des émotions est traduite en anglais une première fois en 1948 1 . Elle le sera une seconde fois en 1962. Ces traductions ont suscité de nombreux comptes rendus et ont donné lieu depuis lors à de nombreuses lectures du petit livre de Sartre, alors que l?ouvrage a longtemps été négligé par les travaux de langue française 2 . En 1950, deux articles de grande qualité scellent cet intérêt anglo-saxon pour l??uvre de Sartre en général, (...) et pour l? Esquisse d?une théorie des émotions en particulier, dans cette période d?immédiat après-guerre. Le premier est écrit par Günther Stern, le second par Frederik Jacobus Johannes Buytendijk 3 . Ils adressent des questions fondamentales au livre de Sartre, à propos du rapport de l?émotion à la réalité d?une part, du rapport de l?émotion au langage de l?autre. BatsonIn late August 1546, Philip Melanchthon had some seriously strange dreams. One night, he saw a man in the Elbe struggling to keep his head above the river's powerful current. As Melanchthon approached to help, he recognized the drowning man's visage: Charles V. Despite Melanchthon's attempts to (...) save him, the river dragged the emperor under and carried him away. Another night, he dreamed that while translating Demosthenes with his friend Joachim Camerarius in the Wittenberg castle (a Melanchthon dream if there ever was one!) he looked out a window to see that the Elbe had turned to blood.1 [End Page 713]These ominous visions reflected the precarious world Melanchthon faced in late summer 1546. Martin Luther, the hero of the German Reformation, had died in February, leaving a gaping hole in the evangelical movement. Further, German Protestantism was facing the largest political crisis in its short history. The Schmalkaldic War had begun in July, only a few weeks prior, and the Reformation faced intense military pressure from Charles V. As the emperor slowly advanced, an anxious Melanchthon lived in constant tension between wild hope that Charles would be defeated and grim fear of massive bloodshed.As the war began, Melanchthon was greatly disturbed by the violence and the potential for disastrous defeat of the Protestant cause. In an August 26 letter, he wrote this to a friend: "Often now, when I look over the Elbe River gliding by me, I sigh and think that, even if I could pour forth a river of tears as great as the Elbe's flow, I would never be able to exhaust the sadness which surrounds my soul because of this civil war. If only Charles had not started it!"2 Should the Schmalkaldic League be defeated and political support for the Reformation be crushed, the true church would be in dangerous waters, just like the emperor in Melanchthon's dream.In the midst of this impending catastrophe, on September 1, 1546, Melanchthon published an unusual work: the Collatio actionum forensium Atticarum et Romanarum praecipuarum (A comparison of the principal Attic and Roman legal actions). In this study, Melanchthon organized and compared the legal actions of Athens and Rome, following the order of the Ten Commandments. In 1546, Greek law was a virtually unknown field. Contemporary legal humanists like Andrea Alciato, Ulrich Zasius, and François Baudouin had devoted their attention almost exclusively to Roman or feudal European law.3 Nearly a century before the publication of sprawling [End Page 714] tomes by the Greek legal scholars Samuel Petit, Claudius Salmasius, and Johannes Meursius, Melanchthon treated the law of ancient Athens as a worthy subject.4 Even more puzzling, Melanchthon devoted himself to this arcane work during a moment of dire political crisis. The unusual subject matter of the Collatio and the urgent circumstances surrounding its publication raise a pair of intriguing questions: Why did Melanchthon think Attic legal actions were important? And why did he think they were worth studying while a military and political disaster loomed on the horizon?Melanchthon valued the ancient pagan laws because they showed how God had revealed legal and moral principles to the gentiles. His study of Attic and Roman law demonstrated how, through natural reason, the classical pagans had attained knowledge of the natural law and implemented it in their own societies.5 As a result, the ancient laws became indispensable to Christians studying law and moral philosophy.6 This work on ancient Greek law was an essential part of Melanchthon's pedagogical project of integrating Christianity and the classical world. As he wrote in the introduction, he had decided to write on Attic legal actions "so that students may know that they are not only formulas for litigation, but also a philosophy and a doctrine of virtue."7 By reconstructing the laws of ancient Athens and comparing them with those of Rome, Melanchthon demonstrated that classical moral and legal thought was in complete agreement with the Decalogue and essential for Christian moral development. Johann Georg Hamann (1730-1788) is a major figure not only in German philosophy but also in literature and religious history. In his own time he wrote penetrating criticisms of Herder, Kant, Mendelssohn, and other Enlightenment thinkers; after his death he was an important figure for Goethe, Hegel, Kierkegaard, and others. It was only in the twentieth century, however, that the full and radical extent of his 'linguistic' critique of philosophy was recognized. This volume presents a new translation of a (...) wide selection of his essays, including both famous and lesser-known works. Hamann's enigmatic prose-style was deliberately at odds with Enlightenment assumptions about language, and a full apparatus of annotation explains the numerous allusions in his essays. Die Tradition der Metaphysik, auf die sich die Neuzeit bezieht verdankt ihre Physiognomie den systematischen Ansätzen, die den nach Aristoteles „zweiten“ Anfang der Metaphysik im 13. Jhd. Bestimmen. Der Zusammenhang, der die mittelalterliche Metaphysik mit der neuzeitlichen Metaphysik und Metaphysikkritik verbindet, ist jedoch immer noch zu wenig erforscht. Die vorliegende Untersuchung greift den einflußreichsten der mittelalterlichen Ansätze, den des Johannes Duns Scotus, auf und verfolgt seine Rezeption und Transformation über Francisco Suárez und Christian Wolff zu Immanuel Kant und Charles (...) Sanders Peirce. Nach Duns Scotus ist Metaphysik als Wissenschaft vom Seienden als Seienden nur dann möglich, wenn man sie nicht als Wissenschaft vom ersten ausgezeichneten Seienden, sondern als Wissenschaft vom ersterkannten Begriff des Seienden versteht. Da dieser Begriff nur im Rückgang auf die Voraussetzungen unserer kategorialen Prädikate erfaßt und nur im Durchgang durch seine modalen Bestimmungen entfaltet werden kann, faßt Scotus Metaphysik strikt als „Transzendentalwissenschaft“ (scientia transcendens) und ordnet ihr als Inhalt die formalmodale Bestimmung und Explikation der „ratio entis“ zu. Human oversight has become a key mechanism for the governance of artificial intelligence (“AI”). Human overseers are supposed to increase the accuracy and safety of AI systems, uphold human values, and build trust in the technology. Empirical research suggests, however, that humans are not reliable in fulfilling their oversight tasks. They may be lacking in competence or be harmfully incentivised. This creates a challenge for human oversight to be effective. In addressing this challenge, this article aims to make three contributions. (...) First, it surveys the emerging laws of oversight, most importantly the European Union’s Artificial Intelligence Act (“AIA”). It will be shown that while the AIA is concerned with the competence of human overseers, it does not provide much guidance on how to achieve effective oversight and leaves oversight obligations for AI developers underdefined. Second, this article presents a novel taxonomy of human oversight roles, differentiated along whether human intervention is constitutive to, or corrective of a decision made or supported by an AI. The taxonomy allows to propose suggestions for improving effectiveness tailored to the type of oversight in question. Third, drawing on scholarship within democratic theory, this article formulates six normative principles which institutionalise distrust in human oversight of AI. The institutionalisation of distrust has historically been practised in democratic governance. Applied for the first time to AI governance, the principles anticipate the fallibility of human overseers and seek to mitigate them at the level of institutional design. They aim to directly increase the trustworthiness of human oversight and to indirectly inspire well-placed trust in AI governance. (shrink)

Johann Georg Heinrich Feders Schriften bieten einen repräsentativen Einblick in die Entwicklung des philosophischen Denkens, die der deutschsprachige Empirismus zwischen den späten 1760er und den frühen 1790er Jahren nahm. Mit dieser ersten, kommentierten Edition der Schriften des berühmtesten zeitgenössischen Kant-Kritikers entsteht ein plastisches Bild der,Neuen Göttinger Wissenschaften‘ während der Spätaufklärung. Neben zahlreichen Zeitschriftenbeiträgen und Rezensionen werden paradigmatische Auszüge aus schwer zugängigen Monographien Feders präsentiert. So wird erstmals wird Feders einflussreiche Dissertation „De sensu interno“ im Original und in einer Übersetzung (...) vorgestellt. Johann Gottlieb Fichte hielt im Sommer 1805 in Erlangen öffentliche Vorlesungen zum Thema 'Über das Wesen des Gelehrten und seine Erscheinungen im Gebiete der Freiheit'. In diesen Vorlesungen erläuterte Fichte sein Verständnis des Wesens und der Aufgabe des Gelehrten und führte in seine Philosophie ein. Dieser Text ist ein wichtiges Zeugnis nicht nur für die Entwicklung von Fichtes Philosophie, sondern auch für die Geschichte des Deutschen Idealismus und das Verständnis von Bildung und Wissenschaft im frühen 19. Die erst im Juli 1980 gefundene, bis dahin gänzlich unbekannte Kolleghandschrift von Krause aus dem Wintersemester 1798/99 erweitert den Wissensstand um die Entwicklung der Philosophie Fichtes zwischen den Jahren 1795 und 1800 in einem erheblichen Maße und markiert eine Zäsur: Fichte scheidet die Philosophie nicht mehr in Theorie und Praxis, sondern faßt sie als eine, als Philosophie überhaupt.

Im Zentrum seines Werkes steht Fichtes WL, die er siebenmal bearbeitete. Die zweite Darstellung, die Grundlage der gesamten Wissenschaftslehre , in der er das Wissen von Tatsachen von den Prinzipien der Gegenstandserfahrung aus erörtert, ist die einflußreichste geblieben. Fichte hat in der Gegenstandserfahrung nicht nur die praktischen, sondern auch die theoretischen Prinzipien aufgezeigt und damit die Verbindung von theoretischer und praktischer Vernunft nachgewiesen. Sein Werk wurde durch diese Leistung Ausgangspunkt des deutschen Idealismus.

Mit dem Entwurf eines merkantilistischen, autarken und sozialen Ständestaates liefert Fichte eine der geschlossensten Konkretisierungen seiner rechtspolitischen Ideen, nämlich das erste Modell einer sozialistischen Planwirtschaft. Zugleich berührt das Werk ein Kernproblem von Fichtes praktischer Philosophie: Wie läßt sich die freie Selbsttätigkeit der Einzelnen mit der alle auf ein Ideal verpflichtenden Hoheit des Vernunftsstaates vereinigen?
